These Terms of Use (these “Terms”) govern access to and use of the publicly accessible portions of the website located at pentaria.com (the “Website”) operated by Path 6, LLC, a Texas limited liability company doing business as Pentaria (“Pentaria,” “we,” “us,” “our”). These Terms apply to anyone who visits or uses the Website, including prospective customers, job applicants, and other visitors (“you”).
These Terms do not apply to the password-protected portion of Pentaria’s website through which business customers browse, license, and download Pentaria’s AI skills, agents, plugins, software, prompt templates, playbooks, and related tools (the “Materials”); that portion, and any license to use the Materials, is governed instead by Pentaria’s Terms of Service or a Master Services Agreement, as applicable.
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
The Website is intended for general business audiences. It is not directed to children under 16, and Pentaria does not knowingly collect personal data from children through the Website. If you are under 18, you may use the Website only with the involvement of a parent or guardian.
All text, graphics, logos, trademarks, articles, guides, and other content on the Website (excluding the Materials, which are governed separately) is owned by Pentaria or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and print pages from the Website for your own personal, non-commercial, or internal business reference, but may not otherwise copy, reproduce, republish, distribute, or create derivative works from Website content without Pentaria’s prior written consent.
You will not: (a) use automated means, including bots, scrapers, or crawlers, to access or extract content from the Website, other than standard search engine indexing; (b) attempt to gain unauthorized access to any portion of the Website, including the password-protected Site described above; (c) interfere with or disrupt the Website’s operation or security; (d) submit false, misleading, or malicious information through any Website form, including demo requests or contact forms; or (e) use the Website in violation of applicable law.
Content on the Website, including blog posts, guides, templates, previews, and other materials, is provided for general informational purposes only and does not constitute professional, legal, financial, or business advice. Pentaria makes no warranty that any outcomes, results, or benefits described on the Website will be achieved by any particular visitor or organization.
The Website may link to, or integrate with, third-party websites or services — for example, scheduling tools for demo requests or embedded videos. Pentaria does not control and is not responsible for the content, availability, or practices of those third parties.
THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PENTARIA DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PENTARIA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE, AND PENTARIA’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
This limitation does not apply to liability that cannot be limited under applicable law. It does not affect the separate liability terms in Pentaria’s Terms of Service or Master Services Agreement, which govern Customer’s use of the Materials.
Pentaria’s collection and use of personal data through the Website is described in Pentaria’s Privacy Policy, available at pentaria.com/privacy, which is referenced here for your information but is not incorporated into these Terms.
9.1 Informal Resolution. Before filing a claim, you and Pentaria agree to try to resolve the dispute informally by contacting the other in writing and engaging in good-faith discussions for at least 30 days.
9.2 Binding Arbitration. Except for claims for injunctive relief regarding intellectual property, or claims that qualify for small claims court, any dispute arising out of or relating to these Terms or the Website will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer or Commercial Arbitration Rules, as applicable, conducted in Austin, Texas (or virtually, by agreement), in English, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
9.3 CLASS ACTION WAIVER. YOU AND PENTARIA AGREE THAT ANY PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court rather than arbitration.
9.4 Opt-Out. You may opt out of this arbitration agreement by sending written notice to legal@pentaria.com within 30 days of first accepting these Terms, identifying your name and stating an intent to opt out.
9.5 Governing Law. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles, except that this Section 9 is governed by the Federal Arbitration Act. For any claim not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.
Pentaria may update these Terms at any time by posting a revised version with a new effective date. Continued use of the Website after changes take effect constitutes acceptance of the revised Terms.
11.1 Severability. If any provision of these Terms is unenforceable, the remaining provisions remain in effect.
11.2 No Waiver. Failure to enforce a provision is not a waiver of future enforcement.
11.3 Relationship to Other Agreements. These Terms do not modify, and are separate from, Pentaria’s Terms of Service, Master Services Agreement, Authorized User Agreement, or Data Processing Addendum, each of which governs its own specific subject matter as described in that document.
11.4 Entire Agreement. These Terms constitute the entire agreement between you and Pentaria regarding use of the publicly accessible Website.
